HCC Insurance Faces Lawsuit Over Failure to Pay Promised Insurance Benefits

Cohen & Malad, LLP filed a class action lawsuit with several other law firms including Lieff Cabraser Heimann & Bernstein, LLP; Carney Bates & Pulliam, PLLC; Cuneo Gilbert & Laduca, LLP; and Mehri & Skalet against HCC Medical Insurance Services, LLC; HCC Life Insurance Company, and Health Insurance Innovations, Inc. on behalf of consumers who purchased short-term insurance policies and were denied promised benefits. The lawsuit alleges consumers who purchased short-term policies, lasting from six months to two years, from HCC were systematically denied claims. Court documents state that HCC would locate a pre-existing condition well beyond the contracted-to period to deny a valid claim or would locate a medical condition that would have made the policy holder ineligible for insurance in the first place, a practice known as “post-claims underwriting”.
