Sexual Assault is not Medical Care: Butler University Case Advances with Ruling in Favor of Victims
The case against former Butler athletic trainer Michael Howell, Butler University and its Director of Athletics, Ralph Reiff, is moving forward.
Our clients and other student-athletes on the Butler Women’s Soccer Team reported the sexual assault, proved their allegations in an extensive investigation and Title IX hearings, then tried for months to obtain justice from Butler before filing suit.
The university’s attempt at dismissal by asserting victims’ abuse allegations constitute medical malpractice — and thus have to pass an administrative medical review panel — was denied when Judge James Sweeney ruled that “sexual abuse is not medical care.”
