Gabriel joined CohenMalad, LLP in 2007 after graduating with honors from Indiana University Maurer School of Law and following a judicial clerkship with the Indiana Court of Appeals. Gabriel focuses his practice in the areas of complex litigation, personal injury, business litigation, and appellate litigation.
In addition to overseeing a robust trial docket, Gabriel has a wealth of experience in appellate advocacy as a result of his clerkship and has served as lead counsel in several of the featured cases listed below. In addition to serving as lead trial counsel in cases in Indiana, Kentucky, West Virginia, Florida, Texas, and Oregon, Gabriel has served as lead counsel on numerous cases before the Indiana Court of Appeals, the Indiana Supreme Court, and the Federal Court of Appeals for the Fifth, Seventh, Ninth, and Eleventh Circuits. Gabriel also has a robust federal trial practice and prosecuted cases before federal courts in Indiana, Florida, Oregon, Texas, and Illinois.
Gabriel specializes in complex, high-value litigation and served in key roles on several notable and highly-publicized cases including: In re 2005 U.S. Grand Prix, the Weinberger medical malpractice litigation, the Gandhi medical malpractice litigation, and ViaStar Energy, LLC v. Motorola, Inc.
Gabriel is particularly proud of his work in Bixby, et al. v. KBR, Inc., a complex toxic tort case in which American and British soldiers were exposed to a deadly carcinogen. The jury returned a verdict of $85,200,000 in favor of these soldiers.
NON-LEGAL ACTIVITIES
Gabriel is the president of Indy Chess, a non-profit that promotes chess in Indiana and provides free chess lessons to low-income students throughout Indianapolis. Gabriel is also very involved with his Parish of Saint Joan of Arc. In addition to other ministries, Gabriel has twice chaired the Saint Joan of Arc Winter Reverse Raffle, is an usher, and assists with administering the Parish’s French Market. Gabriel, lastly, supports his alma mater by serving on the Moot Court Board at the Indiana University Maurer School of Law.

- In this trio of cases, Gabriel served as the lead attorney for the Indiana Trial Lawyers Association and was instrumental in assuring that bar patrons injured by an assault have a right to judicial redress.
Myers v. Crouse-Hinds Division of Cooper Indus, Inc., 53 N.E.3d 1160 (Ind. 2016)
- Gabriel served as the lead attorney for the Indiana Trial Lawyers Association and was specifically acknowledged in the resulting opinion as having advanced the argument that reinstated the right of asbestos exposure victims to obtain judicial redress in Indiana.

- Gabriel served as the lead attorney in this case which allowed for sexual assault victims to recover for injuries inflicted upon them by medical providers.

- Gabriel served as primary brief writer and played a significant role in obtaining a settlement in this multi-million dollar contract dispute.
Filter Specialists, Inc. v. Hendi, 2008 WL 11391139 (N.D. Ind., Nov. 17, 2008)
- Gabriel served as the primary brief writer in a case wherein he successfully prevented a company from unfairly using a non-compete provision to keep its former employee from working for its competitor.
Bixby v. KBR, Inc., 2012 WL 4063498 (D. Or., Sept. 13, 2012)
- In this case involving KBR’s exposure of soldiers to a deadly carcinogen, Gabriel was instrumental in obtaining an $85,200,000 verdict. Gabriel served as primary brief writer, was responsible for expert depositions, Daubert motions, and performed numerous other trial and non-trial functions that were essential to this verdict.

- In these two cases, Gabriel successfully defended mass tort trial verdicts in cases involving a doctor’s unnecessary and harmful sinus surgeries.

- Gabriel served as the lead attorney and was instrumental in creating a rule of law that prevented negligent medical providers from restricting what arguments their victims can advance at trial.
Dennerline v. Atterholt, 886 N.E.2d 582 (Ind. Ct. App. 2008)
- Gabriel assisted with sustaining this $17.9 million verdict in a case involving individuals who were improperly deprived of health insurance coverage.

- Gabriel served as the lead attorney and sustained a default judgment against a company accused of subjecting a mentally disabled client to sexual assault.

- Gabriel served as the lead attorney and helped create a rule of law that would not prevent medical malpractice victims from having their recovery unfairly capped by prior settlements.

- Gabriel successfully obtained summary judgment against an attorney accused of committing legal malpractice.

- By way of this real estate dispute, Gabriel served as lead attorney and successfully advanced a unique theory that allowed his clients to obtain attorney fees underlying an adverse possession dispute.

- Gabriel served as the lead attorney for the Indiana Trial Lawyers Association and helped create a rule that protects the confidentiality of medical records.
Daniels v. FanDuel, Inc., 109 N.E.3d 390 (Ind. 2018)
- Gabriel helped college athletes obtain rights concerning their publicity by way of a question that the 7th Circuit Court of Appeals certified to the Indiana Supreme Court.

- Gabriel served as the lead attorney and successfully assisted an attorney who was unfairly deprived of fees that he obtained by way of a settlement.

- Gabriel served as the lead attorney and successfully assisted a financially-disadvantaged mother in overturning on appeal an adverse trial court decision regarding the custody of her son.
