NFL Concussion Settlement Appeals Information
Retired NFL players who suffered concussive injuries while playing in the league or one of its member clubs – American Football League, World League of American Football, NFL Europe League or NFL Europa League — may be eligible to receive compensation for their injuries as a result of a class action settlement. The court has granted preliminary approval of the settlement and injured parties now need to submit a claim package in order to receive a monetary award. Class members who submit a claim that is not approved or are offered a settlement that they consider not to be full compensation for their injuries can file an appeal of the proposed settlement. In this case, it would be beneficial to consult with an attorney who has experience with the claim submission process and class action litigation.
How appeal an NFL concussion settlement offer
The court has provided instruction for submitting an appeal of monetary awards. Important things to note regarding the appeals process:
- The class member must pay a $1,000 fee to file the appeal – this will be refunded if the appeal is successful
- Appeals are limited to five single-spaced pages and subject to proof by clear and convincing evidence
- The Court has the ultimate decision regarding any appeal but may consult with a member of an Appeals Advisory Panel for medical advice
Court documents related to the concussion settlement do state that if an appeal is unsuccessful that a class member may submit another claim package to obtain compensation. However, it is also noted that repeated claim submissions may trigger an audit.

Amid concerns of the long-term effects of repeated head trauma and medical diagnoses of chronic brain injury in former players in the NFL, more than 4,500 retired and former NFL football players filed a class action lawsuit against the league. The lawsuit alleged that the NFL was aware of the long-term effects that repeated blows to the head could cause and failed to protect players. Alzheimer’s disease, dementia, ALS or Lou Gehrig’s Disease, and CTE or chronic traumatic encephalopathy are all diseases that may develop as a result of repeated head trauma. Many former NFL players have been diagnosed with these ailments as well as others related to cognitive deterioration.
