Nationwide Class Certified in Action Against Celadon Trucking for Excessive Deductions from Drivers’ Compensation

On April 23,  the Marion Superior Court certified a nationwide class and appointed Cohen & Malad, LLP as class counsel in a class action lawsuit against Celadon Trucking seeking the return of millions of dollars in excessive deductions from the compensation of independent owner-operator drivers of long-haul trucks. The lawsuit alleges that Celadon breached its form Lease Agreement with the drivers by deducting from the drivers’ compensation more in fuel charges than Celadon actually paid to Pilot Flying J to purchase that fuel. The lawsuit alleges that Celadon had an undisclosed arrangement to pay Pilot Flying J less for the fuel than the amount shown at the pump.  The matter is set for trial in Indianapolis on March 10, 2015.
