Nissan Faces Lawsuit Over Faulty Automatic Emergency Braking System

Cohen & Malad, LLP filed a class action lawsuit against Nissan North America, Inc. over defective automatic emergency braking systems that can activate suddenly putting drivers and passengers at risk of immediate and unexpected danger. The lawsuit was filed on behalf of owners and leasees of 2018 models of Rogue, Rogue Sport, Altima, Murano, LEAF, Pathfinder, Maxima and Sentra models as well as several models manufactured between 2015 through 2017.

Some drivers claim the braking system has unexpectedly engaged when no other vehicle or obstacle was present causing the vehicle to decelerate and stop while traveling at a high rate of speed putting them at risk for injury. Numerous drivers claim the automatic braking systems engage at random times when they are traveling at various speeds with no obstacles present. The lawsuit alleges Nissan was aware of the defect in the automatic emergency braking technology but failed to warn drivers or take action to fix these vehicles.
