The business litigation group pursues its clients’ objectives in such cases through a wide variety of means, including negotiations, formal and informal mediation, binding and non-binding arbitration, and through litigation when necessary. Client interests may include bringing or defending damages claims, seeking injunctions or resisting attempts to obtain injunctions, defending administrative claims and many other factors, both legal and practical
The group has a small but effective core group of permanent attorneys, and the ability to call on the firm’s other resources as needed. This flexibility allows the group to scale its staffing to each individual case to more efficiently deliver the appropriate level of representation.
The group has also moved beyond the hourly billing model where appropriate, and offers a variety of alternative fee arrangements, including fixed fees and percentage fees, as well as “blended” arrangements that combine lower hourly or fixed fees with a “success fee” contingent on obtaining a result in the case that meets agreed client benchmarks.
Cohen & Malad has the ability to provide litigation coverage throughout the United States via Legal Netlink Alliance, a network of independent law firms dedicated to providing top quality legal services without the inefficiencies so often generated by larger, more cumbersome law firms.
In addition to its business litigation and dispute resolution services, the group offers free seminars for in-house lawyers, focused on various topics that arise in litigation, with a focus on steps that clients can take to best position themselves for future litigation.
