Mr. Cutshaw acted as class counsel in a securities fraud class action against Cummins Engine. The District Court dismissed the case; and Mr. Cutshaw argued the appeal to the Seventh Circuit which reversed the District Court’s decision. Stransky vs. Cummins Engine Co., Inc., 51 F. 3d 1329 (7th Cir. 1995). The Stransky decision has since been cited by numerous courts with favor as to an issuer’s duty to update material information. After the case returned from the Seventh Circuit, a class was certified; and the case was settled in the seven figure range.
