After a seven day trial, the jury returned a verdict of $1.3 million in favor of the plaintiffs Judy and David Timbrook, represented by David Cutshaw and Leslie Gibson of Cohen & Malad, LLP, against Dr. Larry Micon in Marion County Superior Court.
The case involved a female patient who had surgery, during which her ureter (the tube that carries urine from the kidney to the bladder) was injured. She began leaking urine from her incision and did so for 2 ½ months before the ureter injury was diagnosed by another doctor. Doctor Micon failed to do any simple diagnostic tests (costing less than $100) to determine the cause of the fluid (later recognized as urine) draining out of her incision over those 2 ½ months. As the result of the malpractice, her incision opened up to the size of a softball and she lost her left kidney, among other serious medical problems.
